EPA Gets Overturned On SF Salt Pond Oversight

A California federal judge tossed the U.S. Environmental Protection Agency's finding that salt ponds near San Francisco Bay are not covered by the Clean Water Act, instructing the agency to reconsider the issue and pointing toward a prior appeals court decision that called for regulation... San Francisco Baykeeper and others say the designation matters because developers would no longer have to obtain permits under the CWA for dredge and fill activities to build on the site if the agency's determination were to hold. Environmental activists have said developers that previously pushed for a large residential project could revive their plans.
